Intention notice: GIS systems from Geodata AS Bane NOR plans to extend the contract for the procurement of ESRI and VertiGIS software, as well as Norwegian adaptations and products adapted to the software portfolio from Geodata AS. Bane NOR intends to extend the agreement with an option for the operation of the system at kubernetes with the accompanying licences known as ArcGIS Enterprise for Kubernetes. Geodata AS is the only tenderer in Norway who has the sole right to distribution of Esri software, including AGEK and adapted Norwegian systems. This notice will be published in accordance with the Supply Regulations as an intention notice upon direct procurement. The Utilities Regulations § 9-3, litra b, number 3 states that the contracting authority can hold a procurement without competition if the procurement concerns services that only a particular supplier can deliver because the supplier has sole right. The above mentioned provision can only be used where there are no cheaper alternatives and that "the lack of competition is not due to the Contracting Authority adapting the procurement documents to a specific tenderer." Bane NOR SF is not aware of any alternatives. The terms for entering into a new contract without a competition will be seen as fulfilled. The contracting authority will wait at least 10 days before the contract is signed, in order to give other tenderers the opportunity to assess whether they can provide equivalent services and respond to the announcement. Estimated annual value: NOK 11 million, excluding VAT.
