Dublin City Council gives notice to invoke Article 32.2(b) (ii) and (iii) for a derogation from public procurement whereby the works, supplies or services can be provided only by a particular economic operator as (ii) competition is absent for technical reasons. Dublin City Council intends to award a contract to Starrus Eco Holdings Ltd. T/A Panda Recycling for the Operation and Management of Civic Amenity Sites and Recycling Services. The maximum value of this contract is €1,000,000 ex VAT.
The final contracts arising from the Framework Agreement for the provision of Civic Amenity and Recycling Services expired on 1st August 2025. A Request for Tender to establish a new Framework Agreement for the provision of Collection of Textiles for Reuse and Recycling was published on 31st October 2025. It is anticipated that any Framework Agreement and contracts that arise from such will be in place by the end of Q1 2026.
It is necessary to agree temporary measures to continue the provision of Civic Amenity and Recycling services as per Article 32.2 (b)(ii) competition is absent for technical reasons due to the cost of replacing compactors, containers and necessary infrastructure in the restricted timeframe before the new Framework Agreement is in place.
Dublin City Council’s Civic Amenity sites must remain open on Health & Safety grounds, as the potential increase in illegal dumping that may arise in the absence of suitable facilities for the proper disposal of waste items poses a threat to public health.
A continuation of the services provided by the incumbent service provider, Starrus Eco Holdings Ltd. T/A Panda Recycling, must be place until a new Framework Agreement is established by the end of Q1 2026.
