In the case, documentation has been obtained from the University of Hawaii which documents that they are the sole provider on the market who can implement the relevant service contract. Documentation has also been obtained from Kongsberg Maritime that supports the University of Hawaii's documentation. Since Kongsberg Maritime has sole rights to its ADCP equipment, and unambiguously expresses that only the University of Hawaii can provide the service in question rooted in the ADCP equipment at the present time, it is considered in our case as documented that there is objectively only one tenderer who can provide the services because of interoperability considerations.
