The Institute for Maritime Operations at the Faculty of Technology, Natural Sciences and Maritime Sciences, has a simulation laboratory at Campus Vestfold. The simulation laboratory is provided by Kongsberg Maritime (KM) and is used for teaching purposes for students affiliated to the institute, as well as training participants from external companies who procure tailored training services from the university. The university is now in the process of developing a training programme for a new customer in a new segment. Integrated wind solutions (IWS) is a company that provides services to offshore wind and they need training on the interaction between footpath operators and DP (dynamic positioning) operators on the bridge. IWS has a fleet of 6 ships that are designed for the operation and maintenance of offshore wind turbines, with equipment primarily delivered by Kongsberg Maritime.
The technical equipment in the simulation laboratory and accompanying software is provided by Kongsberg Maritime, and only Kongsberg Maritime ́s software is compatible with and can be used on the technical equipment. This delivery mainly consists of further development of the existing software to enable simulation of new training systems within the existing platform. A new hydrodynamic simulator model shall be developed, and one of the existing student stations in the simulator park shall be expanded with an operator station for training on footpaths. Kongsberg Maritime has sole rights to the source code for the existing software, and is, thus, also the only supplier who can further develop it.
There are other suppliers of equivalent equipment and software both in Norway and other EEA countries, but as other tenderers ́ software is not compatible with the existing technical platform, a change of software will require a full replacement of the technical platform. It is estimated that the USN has invested between NOK 20-25 million in the existing simulation laboratory and any full replacement of the technical platform and the accompanying software would result in an unreasonable large disadvantage for the USN both in the form of investment costs. Time and costs for alterations and training in new software are also attached. Such a system is therefore not seen as relevant or possible at the present time.
The procurement is above the EEA threshold and conditions for procurements without a competition are deemed to be fulfilled by the fact that competition is impossible due to the tenderer having sole rights, including intellectual property rights, cf. The Procurement Regulations § 13-4(b) no. 3.
