      Tysvær municipality intends to enter into a ten year hire contract for town hall purposes with Aksdal Vest AS, organisation number 924 352 248. The rent object is under construction and shall be located in Aksdal in Tysvær municipality. The hire contract includes a unilateral option for Tysvær municipality to extend the hire period for up to two periods - each for 10 years. The expected take-over date is 01 October 2027. The lease agreement is pursed in PPR S 2-4 letter a), in which there is an exception from the Procurement Act and the regulations for "acquisition or hire of land, existing buildings or other real estate or rights to such property". It has been considered that the rent contract can be established in accordance with existing practices from the Court of Justice of the European Union, c-537/19 In particular, Wiener Wohnen.Tysvær municipality published a notice of intent on the lease on 19 August 2024. Negotiations have been continued afterwards, and Tysvær municipality has obtained a legal assessment on the application of the rent exception in the case from the KS Lawyers. Tysvær municipality is assisted by the Municipal Solicitor in Karmøy.The hire contract is based on a standard rent contract for commercial premises in new/rehabilitated multi-user buildings, with adaptations that are assessed as customary when renting premises for office purposes. The function description for the premises is based on the reference building erected by the landlord at Haugalandet for equivalent purposes.
