The Agency for Water and Sewage has an annual average need for seven 15 - 20 tonne wheeled excavators with drives to their seven crews. See the tender documentation annex 1 Requirement Specifications for further information on the need. A framework agreement will be signed with only one tenderer. The framework agreement is exclusive. The maximum value for withdrawing from the framework agreement is NOK 110,000,000. The concrete amount depends on VAV ́s changing need in the contract period. Emphasis is put on the fact that the framework agreement does not carry any purchasing obligation for VAV. In case C-23/20, the COURT of justice has stated that the contracting authority must state an estimated amount and/or value, as well as the maximum amount and/or value for withdrawals from the framework agreement. When the maximum limit has been reached the starting point is that the framework agreement has expired its effect.
